FreeCloud Drive Terms of Use

1. Provider and Application Status

FreeCloud Drive is provided by Brokct Labs. Website: brokctlabs.com.

FreeCloud Drive is an independent third-party application that uses the Telegram API/TDLib and is part of the Telegram ecosystem within the meaning of the Telegram API rules. FreeCloud Drive is not an official Telegram product and is not endorsed by Telegram.

2. Purpose of the Service

FreeCloud Drive helps the user organize, index, view, upload, and recover their own files using a Telegram account and a Telegram channel selected by the user as storage infrastructure.

3. Telegram Account and Third-Party Services

A valid Telegram account is required to use the application. The user is responsible for their account, compliance with the Telegram Terms of Service, and maintaining access to it. FreeCloud Drive depends on the Telegram API, TDLib, the network, Windows, and other third-party components that may change or be temporarily unavailable.

4. License to the Application

Subject to compliance with these Terms, the user receives a limited, non-exclusive, non-transferable right to install and use FreeCloud Drive for lawful personal or permitted professional purposes. These Terms do not transfer ownership of the application, trademarks, or other intellectual property rights.

5. User Content

The user retains rights to their own files. The user warrants that they have the right to store, copy, process, and transmit content that they add through FreeCloud Drive and will not use the application to violate the law, the rights of third parties, or Telegram rules.

6. Encryption and Privacy

FreeCloud Drive encrypts files before uploading them to Telegram. This application-layer encryption should not be interpreted as a promise of zero-knowledge encryption or as a replacement for Telegram’s or Windows’ own security mechanisms. The user must protect their PC, Windows account, and Telegram session.

7. Backups and Recovery

FreeCloud Drive uses Telegram as external cloud storage for archive data and includes mechanisms for backing up and recovering the archive. However, no storage or backup mechanism can guarantee absolute protection against data loss.

For especially important files, users are advised to keep a separate backup outside FreeCloud Drive and Telegram in advance, so that those files can be recovered independently of FreeCloud Drive operation, Telegram availability, or the state of data stored in Telegram.

7.1 Conditions Required for Recovery

The ability to recover a FreeCloud Drive archive depends on preserving the data that the application creates and uses in Telegram. This includes:

• the Telegram account to which the relevant FreeCloud Drive archive is connected;
• the service channel created by FreeCloud Drive;
• service messages created or used by FreeCloud Drive;
• FreeCloud Drive archive files and service files stored in Telegram;
• service captions on messages and files that contain information required by FreeCloud Drive to identify, associate, and recover data.

For the remainder of this section, such captions are referred to as service captions.

For the archive to be recovered correctly, the specified data must remain available to FreeCloud Drive in the form in which it was created or stored by the application.

Do Not Manually Modify FreeCloud Drive Service Data

The user must not, directly through Telegram, another Telegram client, or a third-party application:

• delete the FreeCloud Drive service channel;
• delete messages or files created or stored by FreeCloud Drive;
• delete, edit, replace, or otherwise modify service captions;
• manually modify other FreeCloud Drive service data unless the application expressly provides such a capability;
• delete the Telegram account to which the archive is linked if the data in that archive is still needed.

Such actions may disrupt the archive structure or make some data unavailable to FreeCloud Drive.

Deleting an archive file or message may result in the irreversible loss of the corresponding file from the archive if no other copy exists.

Deleting or changing a service caption may prevent FreeCloud Drive from correctly identifying the file, determining its location in the archive, associating it with other parts of the data, or using it during recovery.

Deleting the service channel or a substantial portion of the service data may make recovery of the archive partially or completely impossible.

7.2 Telegram Account and Data Retention in Telegram

The user must maintain access to the Telegram account used with FreeCloud Drive for as long as the corresponding archive is needed.

Telegram may delete accounts and associated cloud data in accordance with its own rules, user settings, and inactivity periods. Users are advised to keep such a Telegram account active and check the account auto-deletion settings configured in Telegram.

FreeCloud Drive does not control Telegram’s data retention rules, the operation of Telegram servers, the availability of the Telegram service, or Telegram’s decisions to delete or restrict access to data.

7.3 Limits of Recovery

FreeCloud Drive can recover only data that actually exists, remains accessible through Telegram, and contains the service information required for recovery.

If the Telegram account, service channel, messages, files, service captions, or other data required for recovery have been deleted, damaged, modified, or become unavailable, FreeCloud Drive may not have the technical ability to recover the corresponding files or the entire archive.

FreeCloud Drive cannot recover data that no longer exists in Telegram and for which the user has no other available copy.

8. Prohibited Use

• unauthorized access to other people’s accounts, data, or systems;
• distribution of malware, fraud, spam, or automated abuse;
• infringement of copyright, privacy, or other third-party rights;
• use of the application contrary to these rules, Telegram rules, or Microsoft Store rules.

9. Updates and Changes

Features may change to maintain compatibility, security, the Telegram API, Windows, or app store requirements. Material changes to the Terms must be reflected in the current published version.

10. No Guarantee of Continuity

To the extent permitted by law, FreeCloud Drive is provided “as is” and “as available.” Continuous availability of Telegram, any specific transfer speed, absence of errors, or compatibility with future changes to third-party platforms is not guaranteed.

11. Limitation of Liability

To the extent permitted by applicable law, the developer is not liable for indirect, incidental, or consequential damages, or loss of profits or data, arising from the unavailability of third-party services, loss of access to a Telegram account, user actions, or circumstances beyond the developer’s reasonable control. Nothing in these Terms limits consumer rights or liability that the law does not permit to be limited.

12. Discontinuing Use

The user may stop using the application at any time. Before uninstalling the application, users are advised to make sure that important data is accessible and to understand which copies remain in Telegram.
